Terms and Conditions of CupidoVirtual (cupidovirtual.pt) Last Updated: March 23, 2025 IMPORTANT LEGAL NOTICE - PLEASE READ CAREFULLY BEFORE ACCESSING OR USING THE PLATFORM By visiting, accessing, or utilizing any portion of cupidovirtual(hereinafter referred to as "the Platform"), including but not limited to any features, services, content, interfaces, or related applications, you ("User" or "you") hereby expressly consent and irrevocably agree to be legally bound by the following Terms and Conditions ("Terms"). These Terms represent a comprehensive and enforceable legal contract between you and cupidovirtual.ltd, the exclusive operator and proprietor of the Platform. Non-acceptance of any clause or provision contained herein requires the immediate cessation of Platform use. Legal Entity Identification and Contact Details 1.1 The Platform is owned, operated, and administrated by cupidovirtual.ltd, 1.2 All official correspondence, including inquiries, legal notices, and data access requests, shall be directed to: cupidovirtual@cupidovirtual.pt 1.3 While the Platform is accessible internationally, it primarily serves residents of the United Kingdom and related jurisdictions, subject to the respective laws and regulatory frameworks thereof. 1.4 cupidovirtual.ltd reserves the unrestricted right to amend, suspend, or permanently discontinue any functionality, service component, or feature of the Platform at its sole and absolute discretion, without incurring liability. Eligibility, Capacity, and User Warranties 2.1 Access to and use of the Platform is strictly limited to natural persons who have attained a minimum age of eighteen (18) years. By registering, the User certifies under penalty of perjury that they meet the aforementioned age requirement and possess full legal capacity to enter binding agreements. 2.2 Any misrepresentation regarding eligibility constitutes a substantial breach of these Terms and shall result in immediate termination of access without entitlement to refund or compensation. 2.3 Users acknowledge and accept that account ownership and associated rights are non-transferable. Users remain fully responsible for all actions taken through their accounts. Account Registration, Security, and Content Submission 3.1 Registration requires provision of certain information including, but not limited to: valid email address, secure password, username, date of birth, gender identity, sexual orientation, and physical body type. Users warrant the accuracy and completeness of submitted data. 3.2 No identity verification mechanisms (e.g., photographic ID or SMS confirmation) are required or conducted. Users assume all risk associated with identity integrity and platform interactions. 3.3 Users are solely responsible for safeguarding login credentials. Unauthorized account access shall be presumed to arise from user negligence unless conclusively proven otherwise. 3.4 Users may not upload, submit, or transmit any content that infringes upon the rights of third parties, is unlawful, obscene, defamatory, or otherwise objectionable in nature. Violators are subject to content removal and account suspension. Virtual Currency System ("Coins"), Transaction Policies, and Monetization Mechanics 4.1 The Platform operates a proprietary virtual currency system known as "Coins," which facilitates in-platform interactions. 4.2 Coins may be purchased via secure payment gateway services, currently provided by Stripe. Each messaging transaction costs fifty (50) Coins. 4.3 Coins are intangible and carry no real-world monetary value. They are non-exchangeable, non-transferable, and non-redeemable outside of the Platform ecosystem. 4.4 Coins are valid for the lifespan of the user's account and do not expire. Coins may be accrued through a daily promotional feature called "Wheel of Fortune," awarding twenty-five (25) Coins per eligible engagement. 4.5 Users lacking sufficient Coins are prohibited from initiating messages until additional Coins are purchased or earned. 4.6 Refunds are limited exclusively to unused Coins and are processed upon written request, subject to verification and cupidovirtual.ltd's sole discretion. Disputes pertaining to payments must be directed to the relevant payment processor. User Conduct, Acceptable Use, and Content Governance 5.1 Users must adhere to the highest standards of ethical conduct. This includes abstaining from harassment, impersonation, unsolicited advertising, exploitation, or abuse of any kind. 5.2 Public profiles may not contain nudity or offensive imagery. Although private messages are not actively monitored, users remain bound by applicable legal and community standards. 5.3 All user-generated content, including communications, is retained by the Platform for the duration of the account's existence and may be accessed for service improvement or legal compliance. 5.4 Violation of these content policies may result in immediate account suspension, deletion of content, or legal action where applicable. Intellectual Property Ownership and Restrictions 6.1 All materials, software, algorithms, text, graphics, logos, and documentation comprising or associated with the Platform are protected intellectual property of cupidovirtual.ltd. 6.2 No portion of the Platform, including legal documents, may be copied, distributed, republished, or exploited without express prior written consent from cupidovirtual.ltd. Infringement may result in prosecution. Disclaimers of Warranty and Limitation of Liability 7.1 The Platform is provided on an "as-is," "as-available" basis, with no guarantees as to availability, accuracy, completeness, or uninterrupted functionality. 7.2 cupidovirtual.ltd disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. 7.3 Users acknowledge and accept full responsibility for their interactions and outcomes. cupidovirtual.ltd shall not be liable for indirect, incidental, consequential, or punitive damages, even if advised of such possibilities. 7.4 The Platform reserves the right to terminate or restrict user access without liability for any cause deemed appropriate. Data Rights, Retention, and User Support 8.1 Users may request account deletion via Platform interface. Upon deletion, user data is removed from active databases, though remnants may persist in backup systems or third-party services. 8.2 Data access, correction, and deletion requests may be submitted to cupidovirtual@cupidovirtual.pt. Compliance is subject to verification and legal obligations. 8.3 The Platform utilizes cookies and other tracking technologies for analytics, marketing, and caching. Users may configure preferences to reject certain non-essential cookies. Payments, Refund Policies, and Dispute Resolution 9.1 Payments for Coins are processed exclusively through Stripe. Users agree to abide by Stripe's policies in addition to these Terms. 9.2 Refunds are limited strictly to unused Coins, contingent upon request approval by cupidovirtual.ltd. 9.3 Users experiencing transaction issues must seek resolution through Stripe's support mechanisms. Governing Law and Jurisdiction 10.1 These Terms shall be governed exclusively by the substantive and procedural laws of Portugal, without reference to conflict of laws principles. 10.2 All disputes arising from or relating to Platform use shall be resolved solely within the competent courts of Portugal. Users irrevocably submit to such jurisdiction. Amendments to Terms 11.1 cupidovirtual.ltd reserves the absolute right to modify these Terms at any time. Such modifications become binding upon publication. Continued Platform use signifies acceptance. 11.2 Users are encouraged to review these Terms regularly to remain informed. Intellectual Property Protection of Legal Texts 12.1 Unauthorized reproduction, republication, or use of any section of these Terms and Conditions is strictly forbidden and may result in legal action for infringement. Engagement Facilitation and Use of Moderator-Controlled Profiles 13.1 The Platform may, in certain cases, employ interaction-enhancement mechanisms including, but not limited to, moderator-controlled profiles. These profiles are designed to foster engagement, improve user experience, and encourage utilization of Platform features. 13.2 Users are hereby notified that such profiles are fictitious and do not represent real individuals. They may engage in communication and promote platform usage, including but not limited to suggestions to purchase Coins. 13.3 Interaction with such profiles is voluntary. Engagement does not entitle users to refunds or compensation. BY ACCESSING OR USING THE PLATFORM, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS IN THEIR ENTIRETY.
